About these terms
These terms govern your use of adsomia.com and any free resources we offer (audits, checklists, tools, decision quizzes, newsletters). They do NOT govern paid client engagements — those are governed by a separate Engagement Letter that supersedes these terms for that specific relationship.
Who we are
Adsomia is the marketing brand of Adsomia India Pvt Ltd ("Adsomia", "we", "us"), a private limited company registered in India. Operating offices in Trivandrum (HQ), Kochi, Attingal, and Bangalore. Founder: Hassan Rawther. Contact: social@adsomia.com.
What we offer (free)
On adsomia.com you can — (1) read our content (methodology, glossary, guides, blog, case studies), (2) use our free tools (HEO Checker, AI Visibility Checker, Decision Quiz), (3) download our resources (HEO Checklist PDF, audits in some cases), (4) submit an enquiry to engage us for paid work, (5) sign up for our newsletter. All of these are provided as-is — useful information, but not professional advice for your specific business situation.
What we offer (paid)
We sell five outcome-led marketing engagements — Be Found, Be Bought, Be Chosen, Be Built, Be Led — and a handful of complementary packages (HEO Audit, brand kits, campaign planning). Pricing, scope, deliverables, and timelines are listed on each /outcomes/[outcome] and /packages/[slug] page. The actual contract terms for paid work are in the Engagement Letter we send after discovery.
Engagement letter takes precedence
When you engage us for paid work, we send a written Engagement Letter covering scope, deliverables, timeline, fees, payment milestones, cancellation, IP ownership, confidentiality, and the team named on your account. That letter — once signed — is the legally binding contract. Anything on this website that contradicts your signed Engagement Letter is overridden by the letter.
Pricing
Pricing shown on the website is in Indian Rupees (₹) unless otherwise marked. Founding-client pricing applies to the first 25 customers per outcome OR until end of Q1 2026, whichever first — after that, the listed list price applies. International clients are quoted in USD on request. All pricing is exclusive of GST and any applicable taxes, which are added at invoice time per Indian tax law.
Payment
Standard milestone-based payment for sprints: 40% on signing, 30% at mid-sprint, 30% on handover. Be Led / fractional engagements: monthly retainer, invoiced the 1st of each month, due within 7 days. Late payment may pause the engagement after a 7-day grace period and written notice. Payments by bank transfer / Razorpay — instructions on the invoice.
IP ownership
Two layers. (1) Work product (your site, your content, your campaign assets) — belongs to you on payment in full. We grant you a perpetual, royalty-free, transferable licence. (2) Adsomia methodology, frameworks, internal tools (HEO methodology, audit framework, decision quiz, internal templates) — belongs to Adsomia. You may use them for your own business but not republish or resell them as your own.
Confidentiality
Both directions. We keep your business information confidential indefinitely — strategy, financials, customer data, anything we see during the engagement. You keep our methodology and internal tools confidential to the extent they're not already publicly published. Mutual NDA can be signed separately on request before any discovery call.
What you agree not to do
Don't — (1) scrape the site at volumes that disrupt service, (2) abuse our free tools by submitting other people's URLs to score them, (3) misrepresent our work, methodology, or case-study outcomes, (4) use our content to train a competing AI system, (5) reverse-engineer our internal tools.
Disclaimers
Free content and free tools are provided as-is. We've tried to make them useful but they're general guidance — not professional advice tailored to your specific business, market, or compliance situation. For paid engagements: we commit to the work and the metrics named in your Engagement Letter, but we cannot guarantee specific search rankings, ad performance, revenue, or other outcomes outside our direct control (Google algorithm changes, market shifts, your sales team's capacity).
Limitation of liability
To the maximum extent allowed by law, our aggregate liability to you under or in connection with these terms and any related Engagement Letter is capped at 3x the fees you paid us in the 12 months preceding the claim. We are not liable for indirect or consequential losses (lost revenue, lost goodwill, business interruption) regardless of cause. This cap does not apply to gross negligence, wilful misconduct, or any liability that cannot lawfully be limited.
Termination
We can stop providing free site access if you violate these terms. For paid engagements: cancellation terms are in your Engagement Letter (typical: 14-day refund window for sprints, 30 days' notice for Be Led after the 3-month minimum). Either side can terminate for unremedied material breach with 30 days' written notice.
Changes to these terms
When we make material changes, we'll update the "last updated" date at the top of this page and post a notice on the homepage for 30 days. Continued use of the site after that constitutes acceptance. Current version: May 14, 2026.
Governing law + disputes
These terms are governed by the laws of India. Any dispute not resolved by good-faith discussion within 60 days will be referred to the courts of Trivandrum, Kerala, which will have exclusive jurisdiction. Before going to court, we both agree to attempt resolution in writing.
